1. General

1.1. These Terms of Service (the "Terms") set out the rules for using the Ghosts Mail email service and the conditions on which the Company sells mailbox packages to Users.

1.2. These Terms are a public offer. Registering a free mailbox means accepting the Terms as rules for using the Service. Paying for an Order means full and unconditional acceptance of the Terms. The contract is concluded at the moment of registration or payment respectively and does not require a paper signature.

1.3. If a User does not agree with the Terms, they must stop using the Service and must not place Orders.

1.4. The Terms apply to ghostsmail.com, account.ghostsmail.com, mail.ghostsmail.com and to mailboxes on the ghostsmail.com and ghostemailer.com domains.

2. Definitions

2.1. Service — the Ghosts Mail email service, including the websites listed in clause 1.4, webmail and IMAP access to mailboxes.

2.2. Company — Talivio Technology OÜ, which operates the Service, sells Digital Goods in it and accepts payment for them.

2.3. User — a natural or legal person using the Service. Buyer — a User who has placed or paid for an Order.

2.4. Mailbox — an email account in the Service on the ghostsmail.com or ghostemailer.com domain.

2.5. Digital Goods — a package of Mailboxes provided electronically: credentials (address and password) for the created Mailboxes. No physical medium is delivered.

2.6. Product Description — the order page in the Service showing the number of mailboxes, domain, login type, price and conditions of use.

2.7. Order — a Buyer's request to purchase a package of Mailboxes.

2.8. Payment Provider — an organisation that accepts payments from Buyers under an agreement with the Company.

2.9. Third-Party Service — a website or app of a third party where the User uses a Mailbox address (for example, to register or receive a verification code). The Company does not own Third-Party Services and is not responsible for their operation or decisions.

3. Subject

3.1. The Company provides free Mailboxes to Users and paid packages of Mailboxes to Buyers. The Buyer pays for the Order and uses the Mailboxes in accordance with these Terms and the Product Description.

3.2. All Mailboxes in the Service are receive-only: sending email, including replies, is not available. Mailboxes are intended for receiving messages, notifications and verification codes and reading them in webmail or over IMAP.

3.3. Each Mailbox has 512 MB of storage. Messages are kept for 30 days after they reach the server and are then deleted automatically.

3.4. The content, price and conditions of a package are stated in its Product Description, which forms part of these Terms. The Company may change prices and Product Descriptions; changes do not affect Orders already paid.

4. Rules of use

4.1. Digital Goods may be purchased by persons aged 18 or over. The Service is not intended for persons under 14.

4.2. Users keep their passwords and Order details (secret code, order link) confidential and are responsible for actions performed with their Mailboxes. Suspected unauthorised access must be reported to support immediately.

4.3. Users must not:

4.4. If these rules are breached, the Company may restrict or block access to Mailboxes. For related breaches, restrictions may apply to all mailboxes of the same Order. Paid but not yet delivered Digital Goods are then either delivered or refunded under section 8.

4.5. Whether to accept a Mailbox address for registration or to deliver messages to it is decided by the relevant Third-Party Service. The Company does not guarantee that a particular Third-Party Service will accept an address or deliver a message to it.

5. Orders and payment

5.1. The Buyer selects the number of mailboxes (from 100), the domain (ghostsmail.com, ghostemailer.com or both) and the login type, reviews the Product Description and total price, provides a contact email address and pays for the Order.

5.2. Before paying, the Buyer checks that the Digital Goods suit their needs, taking into account that mailboxes are receive-only. If anything is unclear, the Buyer should contact support before paying.

5.3. Prices are shown in US dollars. Current rates per mailbox: 100–999 mailboxes — $0.008; 1,000–9,999 — $0.007; 10,000–99,999 — $0.006; 100,000 and more — $0.004. Realistic generated logins cost an additional $0.00059 per mailbox. The rate applies to the whole Order; the total is rounded to cents and fixed when the Order is placed. If paid in another currency, the amount is converted by the Payment Provider at its rate and shown before the payment is confirmed.

5.4. Payments are accepted through Payment Providers using the methods available on the payment page (for example, cryptocurrency via CryptoBot or Heleket, bank card or the Faster Payments System (SBP), where available). Card details are entered on the Payment Provider's secure page; SBP payments are confirmed in the banking app. The Company does not receive or store the full card number, expiry date or CVC/CVV code.

5.5. An Order is considered paid once the Company receives payment confirmation from the Payment Provider.

5.6. Fees charged by the Buyer's bank, payment system or blockchain network, if any, are paid by the Buyer.

5.7. If the Company cannot fulfil a paid Order in full or in part for reasons beyond the Buyer's control, it informs the Buyer and refunds the unfulfilled part or, with the Buyer's consent, offers an equivalent replacement.

5.8. If a payment shows signs of being made without the payment method owner's consent, the Company may suspend the Order and request confirmation. If no confirmation is received, the Order is cancelled and the money is refunded by the same method.

5.9. The Service does not sell auto-renewing subscriptions and has no internal balance: each Order is a one-time payment.

6. Delivery of Digital Goods

6.1. Digital Goods are delivered only electronically — on the Order page as a TXT file in the "address:password" format. There is no physical delivery.

6.2. Mailboxes are created automatically after payment confirmation, usually within a few minutes. Large packages may take longer, but no more than 24 hours after payment confirmation.

6.3. Digital Goods are considered delivered once the credentials file becomes available to the Buyer on the Order page. Access to the Order is protected by a secret code and a personal link, which the Buyer must keep safe. A contact email address alone does not prove ownership of an Order.

6.4. If Digital Goods are not received on time, the Buyer contacts support with the Order number or payment confirmation. Passwords and the Order's secret code must not be sent to support.

7. Rights and obligations

7.1. The Company undertakes to create and deliver Mailboxes in accordance with the Product Description; to provide accurate information about Digital Goods and their limitations; to answer support requests; and to process personal data in accordance with the Privacy Policy.

7.2. The Company may carry out maintenance during which the Service may be temporarily unavailable, change the Service's features and design, and restrict access in case of breach of these Terms.

7.3. The User undertakes to provide accurate contact details, pay for Orders on time, and comply with these Terms, the Product Description and the rules of Third-Party Services where they use the addresses.

8. Refunds and cancellation

8.1. Before Digital Goods are delivered, the Buyer may cancel the Order and receive a full refund.

8.2. If Digital Goods are not delivered through the Company's fault, are delivered incompletely, or some mailboxes do not work (login is impossible), the Buyer may request the missing mailboxes, replacement of non-working ones or a refund of the amount paid for them.

8.3. Mailboxes of proper quality that have been delivered and are accessible are not refundable, unless mandatory provisions of applicable law provide otherwise. Refusal of a Third-Party Service to accept an address, or blocking of mailboxes for breach of section 4, is not a defect of the Digital Goods.

8.4. A refund request may be submitted within 14 calendar days of payment for the Order. The request is sent by email to support@ghostsmail.com or via the support section of the website, stating the Order number and the reason for the refund.

8.5. The Company reviews the request within 3 business days (no more than 72 hours) of receipt and communicates its decision by reply to the email address from which the request was sent, or via support.

8.6. If the request is justified, the Company refunds the money within 10 days of receipt of the request.

8.7. Refunds are made by the same method used for payment. For cryptocurrency payments, refunds are made in the same cryptocurrency to an address confirmed by the Buyer, in an amount equivalent to the US dollar price on the refund date. Crediting time depends on the Payment Provider and the Buyer's bank.

9. Intellectual property

9.1. The texts, images, design, logos and software code of the Service belong to the Company or are used by it lawfully.

9.2. A purchase grants the Buyer the right to use the purchased Mailboxes within the limits set out in these Terms and the Product Description.

10. Liability

10.1. The Company strives to keep the Service running but does not guarantee uninterrupted operation. The Service is provided "as is".

10.2. The Company is not liable for unavailability caused by failures of communication networks, hosting providers or Payment Providers, actions of third parties or decisions of public authorities.

10.3. The Company is not liable for actions and decisions of Third-Party Services, including refusal to accept an address, delayed or undelivered messages, or restriction of the User's accounts on those services.

10.4. The Company is not liable for losses caused by the User sharing access to their mailboxes or Order details with third parties, or by deletion of messages after the retention period stated in clause 3.3.

10.5. The Company's liability for each Order is limited to the amount paid for that Order, unless mandatory provisions of applicable law provide otherwise.

10.6. The parties are released from liability in cases of force majeure.

11. Personal data

11.1. The Company processes Users' personal data in accordance with the Privacy Policy.

11.2. By registering a mailbox or placing an Order, the User confirms they have read the Privacy Policy.

12. Support, claims and disputes

12.1. Questions, claims and requests are sent to support@ghostsmail.com or via the support section of the website.

12.2. The Company answers requests within a reasonable time, usually within 3 business days. Claims are reviewed within 10 days of receipt. Time limits for submitting and reviewing refund requests are set out in section 8.

12.3. The parties resolve disputes by negotiation. If no agreement is reached, the dispute is heard by the court at the Company's seat (Tallinn, Estonia).

13. Governing law

13.1. These Terms are governed by the laws of the Republic of Estonia.

13.2. This does not deprive a consumer Buyer of the protection afforded by mandatory provisions of the law of their country of habitual residence, including any right to bring proceedings in their place of residence where such provisions grant it.

14. Changes to the Terms

14.1. The Company may amend these Terms. A new version takes effect when published on this page unless stated otherwise.

14.2. Orders paid before a new version is published are governed by the version in force at the time of payment.

14.3. By continuing to use the Service after changes, the User agrees to the new version.
